Lue huolellisesti seuraavat käyttöehdot ennen rekisteröitymistä DIGMA-oppimisympäristöön!
Tekijänoikeudet ja aineiston käyttö -osio (Kohta 2) koskee myös rekisteröitymättömiä käyttäjiä.

1. Yleistä

Nämä käyttöehdot koskevat DIGMA-oppimisympäristön käyttöä ja käyttäjän oikeutta käyttää DIGMA-aineistoja. DIGMAn eri aihealueilla (= Moodlen kurssikategoria) ja kursseilla näitä käyttöehtoja voidaan rajoittaa ja täsmentää

Voit käyttää DIGMAn aineistoja:

1. rekisteröitymättä järjestelmään
2. rekisteröityneenä käyttäjänä, opettajan tai opiskelijan roolissa 

Myös suoraan HAKA-palvelulla kirjautuneet ovat rekisteröityneitä käyttäjiä.

Kun rekisteröidyt tai kirjaudut järjestelmään, sitoudut antamaan oikeat henkilötietosi ja hyväksyt rekisteriselosteen ja käyttöehdot. Sitoudut noudattamaan käyttöehtoja DIGMA-oppimisympäristöä käyttäessäsi. Näiden käyttöehtojen lisäksi koulutuksessa noudatetaan järjestävän organisaation sääntöjä. Järjestetyssä koulutuksessa opettaja voi lisäksi rajoittaa omien aineistojensa käyttöoikeuksia.

2. DIGMAn tekijänoikeudet ja aineiston käyttö muissa julkaisuissa

DIGMAn käyttäjä sitoutuu kunnioittamaan hänen käyttöönsä tarjotun materiaalin tekijöiden oikeuksia koulutuksen aikana ja myös sen päätyttyä. Aineistojen oikeudet on määritelty aihealuettain (aihealue = Moodle kurssikategoria), kursseittain tai kurssien sisällä. 

Kansainvälinen tekijänoikeussuoja koskee DIGMAssa julkaistuja kuvia. Jollei toisin mainita, kaikki oikeudet kuviin pidätetään ja seuraavat käyttöehdot ovat voimassa:

1. Saat katsoa kuvia web-selaimella vapaasti ja tulostaa niitä omaan käyttöön.
2. Kuvia ei saa tallentaa, muuttaa, jakaa tai julkaista ilman kirjallista lupaa tekijänoikeuden haltijalta.
3. Kaupallinen käyttö on kielletty.

Sisällöntuottajan oikeudet ja velvollisuudet

DIGMAan saa tallentaa sellaista materiaalia, johon tallentajalla on tekijänoikeus tai joka on hankittu lähteestä, joka sallii sen julkaisun DIGMAssa. Jos on käyttänyt ulkopuolista Creative Commons-lisenssillä julkaistua materiaalia, on ilmoitettava alkuperäinen lähde ja annettava linkki alkuperäiskopion verkko-osoitteeseen. Sisällöntuottajat vastaavat omalta osaltaan siitä, etteivät käytä tekijänoikeuden alaista materiaalia (tekstiä, kuvaa tai ääntä) ilman lupaa.

Tekijällä on oikeus käyttää DIGMAssa julkaistua omaa materiaaliaan vapaasti muualla.

Tekstin havainnollistamiseen tai siteerattujen ajatusten kommentointiin voi käyttää lainattua tekstiä. Tekstiä lainattaessa tulee mainita alkuperäinen tekijä ja lainauksen lähde. Tekijänoikeuslaki suojelee ajatusten luovaa ilmaisua, ei itse tietoa tai ajatuksia.

Jos DIGMAsta löytyy tekijänoikeutta rikkovaa materiaalia on asiasta ilmoitettava ylläpitäjälle.

3. Opiskelijan tuottaman aineiston käyttö

DIGMA-ympäristössä opiskelijana oleva käyttäjä luovuttaa koulutuksen järjestäjälle oikeuden käyttää opiskelijan tuottamaa aineistoa sen koulutuksen yhteydessä, jolle opiskelija osallistuu. Oppilaitos saa valmistaa opiskelijan tuottamasta aineistosta kopioita, joita voidaan jakaa kyseiseen koulutukseen osallistuville opiskelijoille. Koulutuksen järjestäjän käyttöoikeus koskee vain sitä aikaa, jonka opiskelija opiskelee kyseisessä koulutuksessa.

Mikäli koulutuksen järjestäjä haluaa käyttää opiskelijan aineistoa muussa yhteydessä tai muulla tavalla, siitä tulee sopia opiskelijan kanssa erikseen kirjallisesti. Koulutuksen järjestäjä saa kuitenkin säilyttää opiskelijan aineistoa opintosuoritusten arvioimista varten. Järjestelmä voi ottaa opiskelijan aineistosta myös teknisiä varmuuskopioita.

4. Vastuu DIGMAn käytöstä

DIGMAn käyttäjän tulee säilyttää saamaansa käyttäjätunnusta ja salasanaa huolellisesti ja huolehtia siitä, etteivät ne joudu kolmannen osapuolen haltuun. Käyttäjä vastaa tunnuksellaan ja salasanallaan tapahtuvasta DIGMAn käytöstä.

DIGMAn käyttäjä vastaa siitä, että hänen tuottamansa aineisto ei loukkaa kolmansien osapuolten immateriaalioikeuksia tai muita oikeuksia, eikä ole yksityisyydensuojan, hyvän tavan tai lain vastaista.

Ylläpitäjä voi poistaa käyttöehtojen vastaisen aineiston ilmoittamatta. Ylläpitäjä voi estää käyttäjän pääsyn järjestelmään ja poistaa käyttäjän käyttäjätilin, jos tämä rikkoo käyttöehtoja.

Käyttäjä vastaa käyttöehtojen vastaisen toiminnan aiheuttamista vahingoista.

5. Sovellettava laki

Näihin käyttöehtoihin sovelletaan Suomen lakia. Mahdolliset erimielisyydet pyritään ratkaisemaan ensisijaisesti neuvotteluteitse.

6. Käyttöehtojen voimaantulo ja muutokset

Nämä käyttöehdot tulevat voimaan 27.2.2013 ja ovat voimassa toistaiseksi. DIGMA ilmoittaa käyttäjälle näiden käyttöehtojen muutoksista palvelun yhteydessä. Olennaisista muutoksista voidaan lähettää tietoa myös käyttäjän antamaan sähköpostiosoitteeseen. Käyttäjällä on oikeus lopettaa DIGMAn käyttö, mikäli hän ei hyväksy muuttuneita käyttöehtoja.

The Copyright and Use of Materials section (Section 2) also applies to unregistered users.

1. General

These Terms of Use apply to use of the DIGMA Learning Environment, and your right to use the DIGMA materials. In DIGMA's various subject areas (course categories) and courses, these terms of use can be limited and further specified.

You can use DIGMA materials:

1. without signing into the system
2. as a signed-in user, in the role of a teacher or student

Users logging in using the HAKA federation ID service are also considered signed-in users.

By signing in or logging in, you agree to provide your correct personal information and agree to DIGMA's Registry Description and Terms of Use. You agree to abide by the Terms of Use whenever using the DIGMA learning environment. In addition, the rules of the responsible organization are applied. Inside courses, the teachers may further restrict access to their own materials.

2. Copyrights in DIGMA and Use of the Materials in Other Publications

The DIGMA user commits to respect the copyrights of the authors of the material available to them during and after the studies on Digma LMS. The copyrights of the materials are defined by subject area (course category), by course or within the course.

International copyright protection applies to images published in DIGMA. Unless otherwise noted, all rights to the images (including photos) are reserved and the following terms of use apply:

All photos on this site are protected by international copyright laws.  Unless otherwise mentioned, all rights are reserved and the following rules apply:

1. You have rights to personally view the images with your web browser and print them for your own use
2. Images may not be explicitly downloaded, modified, distributed, or republished without the written permission of the copyright holder. 
3. No commercial use of the images is allowed.

Rights and Obligations of Content Providers

In case you store any material in DIGMA, you must be a copyright holder of the material, or the material must be obtained from a source that allows its publication in DIGMA. In case you are using third-party Creative Commons licensed material, you must indicate the original source and provide a link to the original copy in accordance with the Creative Commons specifications. All content providers in DIGMA are personally responsible for not using any copyrighted material (text, images or audio) without permission.

The content providers can use their own materials published in DIGMA freely elsewhere.

Quoted text can be used to illustrate text or comment on quoted ideas. When quoting a text, the original author and the source of the quotation must be mentioned. Copyright law protects the creative expression of thoughts, not the knowledge or thoughts themselves.

If any infringing material is found in DIGMA, the DIGMA administrator must be immediately notified of it.

3. Use of Material Created by Students

Users acting in the role of a student in the DIGMA environment admit a right to use their material to the education provider, within the context of the education that the student participates. The education provider can make copies of the material created by the student, and the material can be distributed to the students participating the same course. These rights of the education provider to the student's material only appliy while the student participates the education in question.

If a provider of education wants to use a student's material in any other context or in another way, a written agreement must be made with the student. However, the education provider may store the student's material for the purpose of assessing academic performance. The learning platform system can also take technical backups of the student's material.

4. Responsibilities in Using DIGMA

Users of DIGMA learning environment must store their personal username and password carefully and ensure that they do not come into the possession of any third parties. The user is responsible for the use of DIGMA with his / her ID and password.

The DIGMA user is responsible for ensuring that the material produced by him does not infringe the intellectual properties or other rights of third parties, and that their content is not contrary to privacy, good manners or the legislation.

The administrator may delete material that violates these Terms of Use without prior notice. The administrator can block the user's access to the system and delete the user's account in case the user violates these Terms of Use.

The user is responsible for damages caused by violation of the Terms of Use.

5. Applicable Legislation

Finnish law applies to these Terms of Use. Any disagreements will be resolved primarily through negotiations.

6. Enforcement and Changes to Terms of Use

These terms of use take effect on 27 February 2013,  and they are valid until further notice. DIGMA notifies the users of any changes to these Terms of Use through DIGMA service. Essential information about changes can also be sent to the e-mail address provided by the user. The user has the right to terminate the use of DIGMA immedialtely, if he does not accept the changed Terms of Use.
